Governor Signs Legislation Clarifying Write-In Candidates

Late Friday evening (June 7), Governor Ducey signed into law HB2134 (municipal elections; write-in candidates), which gives clarity to non-partisan elections, “A write-in candidate cannot advance to the general or runoff election if the candidate did not receive at least the same number of votes as signatures required for nominating petitions for the same office.” Representative Regina Cobb (Legislative District 5) sponsored the bill, and testified during committee hearings, as did City Attorney Carl Cooper and City Clerk Sydney Muhle.

Former statute did not take into account the non-partisan nature of municipal elections. Upon advice from the League of Arizona Cities and Towns, Kingman found itself at the center of litigation in 2018, having applied partisan election rules to a non-partisan race for Kingman City Council vacancies.
